You agree to comply with Terms and Conditions ("Terms") of the website. We may revise these Terms and Conditions from time to time at our discretion. Such changes will be posted on the website for your reference so as to enable you to understand your responsibility as a client. Firm reserves the right to discontinue or modify any or all products or service at any time without notice.

This agreement governs your use of the websites, content and community services offered through www.thursdayventures.in or any other domain name offering our products or services (hereafter called “site” "website"). You (the user) agree to access "website", subject to the Terms and Conditions of use as set out here. Your use of the Site after any amendment to the Terms of Service shall constitute your acceptance of these Terms and Conditions and you also agree to be bound by any such changes/revisions.

Complaints, concerns, or questions regarding third-party products should be directed to the third-party directly.

User account and access

For certain services User is required to register by opening an account by completing the registration process where you also will choose a password and/or a username. User is entirely responsible for maintaining the confidentiality of their password and account. Each registration is for a single individual user only and under no circumstance the content should be shared with multiple users. User agrees to inform the Firm immediately of any unauthorized use of their account or any other breach of security. Firm will not be liable for any loss that User may incur as a result of someone else using their account. However, User may be held liable for losses incurred by company or third party due to someone else using their account.

Declaration by client

​

User agrees that the website may use any platform to route your investment transactions including any proprietary platform but not limited to platform of NJ India Invest Private Limited ("NJ India") or NDX P2P Private Limited ("LiquiLoans"). User agrees to be bound by terms and conditions of respective platform for execution of transactions.

Any communication on the website shall not be considered a solicitation to buy or an offer to sell, or a recommendation for any other product or service or shares or any security, to any person in any jurisdiction where such communication would be unlawful under the laws of that jurisdiction. You agree to read and understood the contents of all the scheme related documents including but not limited to Statement of Additional Information and Scheme Information Document, Key Information Memorandum (KIM) before making the investment and that you have satisfied your self about appropriateness of investment as per the investment objective.

You understand that Mutual Fund and Securities are subject to market risks and there can be no assurance of returns and that the objectives of the schemes may not be achieved. Past performance is not indicative of future returns. User has read all Scheme related documents carefully before investing.

You agree and confirm that the KYC and other personal details provided by you will be correct and accurate. You agree and authorize us to submit required personal/ KYC data/documents to the respective Partner Platforms (including but not limited to NJ India and LiquiLoans), Mutual Funds, Asset Management Companies and/ or their Registrar and Transfer Agents. You agree that signature available in the KRA records would be used for signature verification for processing any request made by you through the Website.

You agree that your Account may be terminated or kept on hold without prior notice if you do not comply with any of our Terms and Conditions or at our discretion.

You acknowledge that you may receive communication over voice calls and messages regarding the Firm services, and products, and such other promotional communications. You consent that such communications are upon your request and authorization, not 'unsolicited commercial communications' as per the guidelines of Telecom Regulation Authority of India (TRAI) and are in compliance with the relevant guidelines of TRAI or such other Governmental Authority.

Mutual fund transactions and Payment

​

Money debited from your Bank Account may be collected in the pool account of the third party service provider and from there it will be credited / transferred to the respective Mutual Funds and you acknowledge that there would be an interim time lag in transferring / crediting the money from the pool account of the third party service provider to the respective Mutual Fund account.

For buy transactions routed using third party service provider, the time of credit to respective AMC Accounts shall be considered for NAV applicability, wherever applicable. The time stamping for online transaction would be the service provider server timings upon submission of transaction by you. In case payment is made through Net Banking the time stamp would be upon successful confirmation of payment. In case, it is found that the payment is not made from a registered bank account, NJ India / Mutual Fund / AMC / its RTA reserves the right to reject the transaction and refund the money to the source account.

Disclaimer of Warranties and Liability

You hereby declare that you will invest from legitimate sources only and will not involve any contravention or evasion of any Act, Rules, Regulations, Notifications or Law.
 

While we endeavor to keep the information on the website up to date and correct, we make no representations or warranties of any kind, express or implied, about the completeness, accuracy or reliability, with respect to the website or products, services, or related data contained on the website. Any reliance you place on such information is strictly at your own risk and peril. Further our website may be susceptible to number of frauds, misuse, hacking, etc. and we will not be responsible for any damages of punitive action on account of the same. You agree to compensate or indemnify or make good any unfair or unjust gain obtained by you as a result of the incorrect credit to you from any party. You also agree to indemnify us and related parties and other intermediaries in case of any dispute regarding validity and/or authorization of your transactions. In no event will we be liable for any loss or damage including without limitation, indirect or consequential loss or damage. Firm shall have no liability to you for any interruption or delay in accessing the website.

You agree not to download or modify or change the site in any manner. You agree that Distributor/AMC/related party shall not be held responsible for any delay/wrong debits on the part of the bank for executing the standing instructions of additional sum on a specified date from my account.

Governing law

​

This Terms and Conditions contained herein shall be governed by and constructed in accordance with the laws of India subject to the exclusive jurisdiction of the courts of Mumbai, Maharashtra, India.

Dispute Resolution

If any dispute arises between User and Thursday Ventures during your use of our Website or period of investment thereafter, in connection with the validity, interpretation, implementation or alleged breach of any provision of these Terms, the dispute shall be referred to a sole Arbitrator who shall be an independent and a neutral third party identified by Thursday Ventures LLP. The place of arbitration shall be Mumbai. The Arbitration & Conciliation Act, 1996, shall govern the arbitration proceedings. The arbitration proceedings shall be in the English language. You are solely responsible for your interactions with any other Client (even to the extent prohibited hereby) and any disputes that may result from such interactions. Thursday Ventures LLP reserves the right, but has no obligation, to monitor disputes between you and such persons.

Thursday Ventures LLP may assign any of its responsibilities/obligations to any other person without any prior notice at its sole discretion. However, you shall not assign, sub-license or otherwise transfer any of your rights or obligations under these Terms and Conditions to any other party, unless a written consent is taken from Thursday Ventures LLP.

Force Majeure

Thursday Ventures LLP is not liable for failure to perform any of its obligations if such failure is as a result of Acts of God (including fire, flood, earthquake, storm, hurricane or other natural disaster), war, invasion, act of foreign enemies, hostilities (regardless of whether war is declared), civil war, rebellion, revolution, insurrection, military or usurped power or confiscation, terrorist activities, nationalisation, government sanction, blockage, embargo, labour dispute, strike, lockout, robbery, theft of data or any interruption or any failure of electricity or server, system, computer, internet or telephone service.

Cumulative Rights

‍The rights and remedies of the Company provided in this Terms and Conditions of use are not exclusive, but are cumulative upon all other rights and remedies to the full extent allowed by law

Interpretation

In this Terms and Conditions, unless the context otherwise requires references to recitals, clauses and sub-clauses are to recitals, clauses and sub-clauses of this Terms and Conditions; headings are inserted for ease of reference only and are not to be used to define, interpret or limit any of the provisions of this Terms and Conditions; references to the singular number shall include references to the plural number and vice versa; words denoting one gender include all genders; any reference in this Terms and Conditions to a statutory provision includes that provision and any regulation made in pursuance thereof, as from time to time modified or re-enacted, whether before or after the date of this Terms and Conditions; and any reference to a time limit in this Terms and Conditions means the time limit set out in the relevant clause or Sub-clause or such other time limit which may be mutually agreed by the parties in writing.

Further, if you do not agree to these Terms and the terms and conditions of NJ India (as available at https://www.njindiaonline.in/terms.php), you shall not use the services and should not proceed to create any accounts from the website pertaining to the Mutual Fund services of Thursday Ventures LLP.
